Пояснительная записка

         Методические рекомендации предназначены для студентов заочной формы обучения  6.070104 "Морской и речной транспорт"  профессионального направления «Судовождение».

Задания составлены согласно программе и в соответствии с учебниками английского языка для высших учебных заведений морского профиля, однако в случае их отсутствия студент-заочник может пользоваться другими учебниками 

с обязательным выбором указанного в программе материала.

Номер варианта, который выполняет студент-заочник, соответствует первой букве его фамилии, а именно: I-А, II-Б, III-В, IV-Г, V-Д, VI-Е, VII-Ё, VIII-Ж, IX-З, X-И, XI-Й, XII-К, XIII-Л, XIV-М, XV-Н, XVI-О, XVII-П, XVIII-Р, XIX-С, XX-Т, XXI-У, XXII-Ф, XXIII-Х, XXIV-Ц, XXV-Ч, XXVI-Ш, XXVII-Щ, XXVIII-Э, XXIX-Ю, XXX-Я  ( исключаются буквы русского алфавита ь, ъ, ы ).

Требования по выполнению контрольной работы:

Контрольная работа должна выполняться аккуратно в отдельной тетради с полями. Нумерация работы, варианта, разделов и предложений должна точно соответствовать заданию. Контрольная работа, выполненная неправильно или неаккуратно, возвращается для доработки. Работа с пометкой "для доработки" должна быть выполнена заново, и в исправленном виде отправлена для проверки с примечанием "повторно".

Тексты, предложения для перевода, вопросы и др. необходимо сначала списать, а потом письменно перевести, ответить на вопрос и т.д. параллельно тексту, предложению, вопросу (на противоположной стороне тетради).

К зачету/экзамену студент-заочник допускается только после успешного устного собеседования по контрольной работе.

Контрольная работа подается на проверку в определенные сроки, установленные планом.

I. Translate the following text.

1. Merchant ships are designed to carry cargo. This cargo may be divided into two basic types: bulk cargo and general cargo. Bulk cargo consists of a single commodity. This commodity is usually carried loose. General cargo consists of a variety of goods. These goods are packed separately. Bulk cargo is carried in specially designed vessels, therefore stowage presents few problems. With general cargo stowage presents many problems, because each item has its own type of packaging and characteristics.

2. For really effective use containers are associated with the most up-to-date handling methods, purpose made cranes and trucks activated by automatic electronic devices, and with computer control. Not all routes are suitable for container traffic, but on those which are, where the flows of cargo are sufficiently dense, the benefits are marked reductions in labour costs, due to the elimination of much handling which would otherwise be necessary and in time spent in port. Other benefits claimed include protection of goods from damage by weather or theft, and a generally lower level of transport and insurance costs.

3. Neither Charterers nor Owners shall be responsible for the consequences of any strikes or lock-outs preventing or delaying the fulfilment of any obligation under this contract. If there is a strike or lock-out affecting the loading of the cargo, or any part of it when vessel is ready to proceed from her last port or at any time during the voyage to the port or ports of loading or after her arrival there, Captain or Owners may ask Charterers to declare that they agree to reckon the laydays as if there were no strike or lock-out. Unless Charterers have given such declaration in writing within 24 hours, Owners shall have the option of cancelling this contract. If part of cargo has already been loaded, Owners must proceed with same (freight payable on loaded quantity only) having liberty to complete with other cargo on the way for their own account.

IV. Develop the following business situations:

  1. Your ship is about to ride at anchor. An anchoring plan should be prepared aboard the ship. What should be taken into account when preparing this plan?

                   (BPG, Ch/L B8).

  1. Discuss with your agent the procedure of delivering the cargo. Ask him to visa all the B/Ls for which freight has been collected. Tell him what additional cargo appliances you will need and how tallying must be arranged for valuable cargoes.

 

V. Translate part of the dialogue by VHF into English. Rewrite the whole dialogue:

  1. I.                      Translate the following text:
  2. Bulk cargo can be divided into liquid or dry bulk cargo. Liquid bulk cargo is carried in tankers. Most tankers are designed to carry crude oil or its refined products, such as fuel oils. The oil is carried in tanks. These are connected by a system of pipes to a central manifold. The cargo is pumped on board at the loading port by shore pumps. At the discharging port the ship pumps the oil ashore using her own pumps. Dry bulk cargo is carried in bulk carriers. The cargo is carried in self-trimming holds. Dry bulk cargo includes grain, iron-ore, coal and sugar. It is loaded automatically by buckets on a conveyor belt system or through large tubes. Although the cargo stows itself, it is important to maintain the ship’s stability and to make sure that the cargo will not move during the voyage. Dry bulk cargo is unloaded by huge grabs of cranes or by giant suction tubes.
  3. The Association surveyors advise what should be done with damaged cargo and, where appropriate, they agree allowances for depreciation, they arrange for reconditioning on the spot or wherever better facilities are available or they arrange sale in the damaged condition locally or wherever they know of a better market. Like the ship surveyors they establish the cause of loss or damage so that underwriters can decide whether there is a claim under their policy.
  4. Owners are to be responsible for loss or damage to the goods or for delay in delivery of the goods only in case the loss, damage or delay has been caused by the improper or negligent stowage of the goods (unless stowage performed by shippers or their stevedores or servants) or by personal want of due diligence on the part of the Owners or their Manager to make the vessel in all respects seaworthy and to secure that she is properly manned, equipped and supplied or by the personal act or default of the Owners or their Manager.

IV. Develop the following business situations:

  1. 1.  Describe the procedure of examining your ship by the Customs during one of your voyages.
  2. 2.  Give the instructions for the foreman how you want to have the barrels stowed in one of the holds. Some of these barrels are leaky. You blame the stevedore for inefficient securing of the rails with ropes and explain him how to secure them properly with chain lashings.

 

  1. V.        Translate part of the dialogue by VHF into English. Rewrite the whole dialogue:

  1. I.                      Translate the following text:

     1. Containerization also has a number of disadvantages. These concern cost and, what might be called, inconvenience. With reference to cost, a containerized transport system is expensive to establish. The shipowner has not only to buy specially designed container ships, but also the containers to go with them. However, these can be hired and some shippers provide their own containers. Special port facilities, such as special cranes, must also be provided by the port authority. These are expensive to build and beyond the means of some countries and port authorities.

2. In most cases the Association surveyors act for underwriters insuring particular cargoes but where a loaded vessel is in distress it is now the practice for the shipowner or his average adjuster to instruct the Association in what is known as the “General Interest” respecting cargo. In such cases the Association advises the shipowner regarding the whole of the cargo and, when the casualty is the major one, a special cargo surveyor is sent from London to cooperate with the master of the vessel in minimizing loss, to record loss or damage, and in general to keep a close watch on the cargo aspect of the casualty. Information concerning maritime casualties pours into the Association daily by cable and telex.

  1. Cargo to be brought alongside in such a manner as to enable vessel to take the goods with her own tackle and to load the full cargo in running working days. Charterers to procure and pay the necessary men on shore or on board the lighters to do the work there, vessel only heaving the cargo on board. If the loading takes place by elevator cargo to be put free in vessel’s holds, Owners only paying trimming expenses. Any pieces and/or packages of cargo over two tons weight, shall be loaded, stowed and discharged by Charterers at their risk and expense.

  2. Your ship is approaching the port where pilotage is compulsory. What information should be exchanged between Master and Pilot and Pilot and Master?

  1. In calculating the total amount of boxes the shore tallyman admitted a mistake. By comparing your entries with the tallyman’s receipts you found out who was to blame for this short-shipping. The shore tallyman was to acknowledge his fault and the missing boxes were delivered to you.

Variant 4

  1. I.           Translate the following text:
  2. With reference to inconvenience, containerization causes a number of problems. Not all cargo can be put into containers. However, the percentage of non-containerizable cargo falls each year as new types of containers are introduced. Another inconvenience is that different types of containers are needed for different journeys and different times of the year. It may also be difficult for a small shipping company to fill a container to capacity with compatible cargo. It is uneconomical to carry half full containers in a ship. However, these difficulties have largely been overcome by the cooperation of all those involved. Finally a containerized system of transport depends on good road and rail links with the port and the surrounding countryside. In some countries these have not yet been developed.
  3. A protest is a declaration by the master, officers and crew, or some of them giving particulars of the voyage, of any bad weather or accident encountered and of the course which under any circumstances of emergency the master has thought proper to pursue. In all cases of putting into an intermediate port or in which either ship or cargo has received damage from any cause, the circumstances should be the subject of a protest made as soon as possible after arrival in port, while the facts are fresh in the declarants’ minds; it should contain a full narrative and be carefully prepared, being, as it is, of great importance in connection with any claim which may arise under insurances, and in the adjustment of any averages.

Protest may also be made by the master against the charterers of the ship, or against the consignees of goods, for not loading or unloading in accordance with Contract or within stipulated time, and by the merchant against the master for misconduct, delay in sailing, not signing Bills of Lading in customary form, and other irregularities.

2. Delivery of the cargo to a person who does not hold a bill of lading is a breach of the bill of lading contract itself and the holder of the bill of lading can bring a claim against the shipowner. The fumes given off by sugar will taint delicate and edible goods which therefore should not be stowed in the same compartment. Thorough ventilation of sugar cargoes, especially raw or partly refined sugar is very important.  When receiving considerable quantities of sugar it often is necessary to separate one parcel from another.

1. Rice should be stowed away from other goods liable to be infested by movement of insects during the voyage. The dunnaging of a rice cargo has to be very thorough and requires careful supervision including the cement chocks, along which the moisture that condenses on the sides, framing etc. finds its way to the bilges. The floor and bilge dunnage should be laid in such a manner as will best ensure air circulation. 1. When it comes to securing of general cargo and cargo units on board ships, up to now very few rules and recommendations have been published. One exception is, however the classification societies’ rules for container securing arrangements. Some classification societies have developed regulations for container securing arrangements. Within these rules, formulae for calculation of the vertical, transverse and longitudinal accelerations have been established. Any of these formulae may be used when designing cargo securing arrangements for any type of cargo on board ships.

В тот же день, 15.07.2008, к 10 часам, танкер-бункеровщик Hobi Maru прибыл и подошел к борту судна с целью швартовки. Непрофессиональное маневрирование и несоблюдение хорошей морской практики бункеровщиком, привело к тому, что   Hobi Maru нанес повреждения правому борту нашего судна.

В следствиe вышеуказанного, я, от имени судовладельцев, прошу владельцев танкера-бункировщика либо фрахтователей CSAV, в качестве их нанимателей, полностью отремонтировать повреждения и/или компенсировать убытки, причиненные небрежным/непрофессиональным маневрированием.

Before commencing to receive cotton, the steam or chemical fire extinguishers should be thoroughly overhauled. While loading or discharging cotton, the fire hoses should be connected and ready for use.

Wet cotton, if stowed in a confined space, will heat and deteriorate, but no danger of spontaneous ignition is to be apprehended. Wet and dry cotton should not be stowed together.

On the other hand, cotton which is or has been in contact with oil or grease is very liable to spontaneous combustion, for which reason holds and especially spar ceiling should not be painted shortly before loading cotton.

1.  Bareboat Charter Party. By this type of charter, the shipowner leases his entire vessel and the charterer has the responsibility of operating it as though it were his own vessel. As the name implies, the bare vessel is chartered. The shipowner has, for the period covered by the charter party, lost control of his vessel. The charterer pays all expenses: fuel, stores, provisions, harbour dues, pilotage, etc. and employs and pays the crew. There may, however, be a clause in the charter party that the master and the chief engineer must be approved by the shipowner. 2. Hatch cover inspections are carried out from time to time by cargo surveyors, usually, but not always, acting on behalf of charterers or cargo interests. These inspections are commonly conducted during loading or immediately before departure. Their purpose is to ensure that a particular cargo is properly loaded into the ship and adequately protected against sea water damage by the hatch covers. Hatch surveys are also made before discharging begins in order that the condition of the cargo, and the extent and cause of any wet damage can be assessed before it is disturbed.

Unless otherwise provided in the charter party, demurrage starts from the time loading or discharging should have been completed. All days are counted, whether or not cargo is worked, including Sundays, holidays and days not worked due to bad weather or other reasons. Once a vessel is on demurrage, it runs consecutively unless otherwise provided in the charter party.

Time Charter Party. By this charter the charterer hires the vessel and her entire carrying capacity for a specified time and for a specified sum per day, payable at specified periods. All the proper cargo space, including that for deck cargo, is at the charterer's disposal. This is sometimes referred to in a charter party as the "Full Reach and Burden" of the vessel and the charterer invariably assumes it to include any mast or deck lockers available and probably a locker or two in the mate's room.

2. Suitable precautions, such as the provision of special lifting gear, should be taken to prevent damage to places containing dangerous substances. In compartments containing cargo, having an explosion or fire risk, all electrical circuits and equipment should meet the recommendations of the International Maritime Dangerous Goods (IMDG) Code. When loading or unloading such cargo, fire-fighting equipment should be rigged ready for immediate use.

1. When the ship has completed loading specification of all cargo on board is prepared, and this is known as the ship's manifest. Copies of manifests are provided by the custom or consular authorities of the country of export and import. Separate manifests must be made out for each port of destination.

The cargo plan shows in diagrammatic form the longitudinal section of the ship and each hold with its respective decks, with main consignments marked off by coloured blocks related to each port of discharge.

When loading operations are completed the agent, or master of the vessel, applies for a clearance of the ship at the local Customs house. The cesser clause has come into common use because very frequently the charterers are not personally interested in the cargo shipped. They may be agents merely, or they may have chartered the vessel as a speculation to make a profit upon the bill of lading freight. The effect of the clause is that when the charterers have shipped a full cargo they have fulfilled all their obligations, the shipowner discharging them from all further liability and taking instead a lien on the cargo for payment of all freight, demurrage or dead freight that may be payable to him. It has become an established rule for the construction of the cesser clause that, if the language used will permit it, the cesser of liability is assumed to be co-extensive only with the lien given to the shipowner; or, in other words, the charterers are released from those liabilities only for which a lien is given to the shipowner. A difficulty which sometimes arises, notwithstanding these precautions, is that although an ample lien is given by the charter-party, the terms of the bills of lading may be insufficient to preserve the same extensive lien as against the holder of the bills of lading. The shippers under the bills of lading, if they are not the charterers, are not liable for the chartered freight, but only for the bill of lading freight; and unless the bill of lading expressly reserves it, they are not subject to a lien for the chartered freight. The master may guard against this difficulty by refusing to sign bills of lading which do not preserve the shipowner's lien for his full chartered freight. But he is often put into a difficulty by a somewhat improvident clause in the charter-party requiring him to sign bills of lading as presented.

Letters of Indemnity. In the interests of honest trade it is essential that a B/L should never contain a false description of the condition or quantity of the goods. A person who buys goods he has never seen on the strength of their B/L description is entitled to a square deal, and if he fails to get one, has a remedy in prosecution for fraud. Cases do arise where a shipper, to avoid difficulties over the financing of a shipment (and sometimes for even less worthy reasons), offers the master or agent of the shipowner a "letter of indemnity" or "back letter" in return for clean bills of lading in circumstances where a qualified bill would appear to be justified. In such letter the shipper gives an undertaking to indemnify the shipowner in respect of any loss or liability the latter may be faced with as a result of issuing clean bills. No master should ever lend himself to this practice, which could possibly result in his being found guilty of conniving at fraud. In any case, a letter of indemnity has no legal standing whatever. It is binding in honour only, and cannot be sued upon should the shipper who issues it go back on his word. In certain trades, however, it appears that some ship­owners and their agents are prepared to issue clean B's/L in exchange for letters of indemnity but, it should be said in all fairness, only in special circumstances in accordance with a resolution adopted by the International Chamber of Commerce. This resolution includes the following principle, viz., that in cases which involve bona fide and substantial grounds for dispute as to condition, number or amount of the goods, the Chamber is of opinion that a solution involving the elimination of letters of indemnity should be sought on the line of an understanding between buyer and seller, but that in the meantime the safeguards at present existing provide valuable assistance in eliminating certain malpractices and represent a very earnest effort, especially on the part of the carriers, although there is a difference of opinion as to their efficacy.
